Protected Works

  • Artistic works: Photographs, paintings, drawings, maps, and architectural works.

Exclusive Rights of the Copyright Owner
The copyright owner has the exclusive right to do, or authorise others to do, the following acts: 

  • Copy the work.
  • Issue, rent, or lend copies of the work to the public.
  • Perform, show, or play the work in public.
  • Communicate the work to the public (e.g., putting it on the internet).
  • Adapt the work (e.g., create a translation or adaptation). 

Moral Rights
In addition to economic rights, authors have "moral rights" which cannot be sold or transferred, though they can be waived. These include: 

  • The right to be identified as the author/director (paternity right).
  • The right to object to derogatory treatment of the work (mutilation or distortion prejudicial to the author's reputation).

Licensing and Infringement

  • Permission is Required: Anyone wishing to use a copyrighted image needs the express permission via a licence from the copyright owner, often involving a negotiated fee and specific terms of use (duration, placement, territory, etc.).
  • Consequences of Infringement: Using an image without permission is copyright infringement. The copyright holder can demand the removal of the image and seek financial compensation through legal action, which can be expensive for the infringing party.*
